Juridiquement, la fraude fiscale se définit comme la soustraction illégale à la législation fiscale de tout ou partie de la matière imposable d'un contribuable. En d'autres termes, le fraudeur paie peu ou pas d'impôt en ayant recours à des moyens illégaux.

Cette notion ne doit pas être confondue avec l'évasion fiscale, qui est une pratique consistant à contourner ou diminuer l'impôt en profitant des possibilités offertes par les règles fiscales ou leurs lacunes (niches fiscales, acquisition d'une autre nationalité, etc.).

Blanchiment de fraude fiscale

La fraude fiscale peut faire l'objet d'un blanchiment lorsque les sommes soustraites sont réintégrées dans le circuit légal. Exemple fréquent : lorsque le contribuable dépose frauduleusement des sommes sur un compte bancaire en Suisse, puis contracte un emprunt d'un montant similaire auprès de cette banque ou d'une de ses filiales. Cette dernière se rembourse alors à partir des sommes figurant sur le compte bancaire tandis que le contribuable utilise cet emprunt pour investir légalement.

Peine et sanctions

Les peines encourues par le fraudeur sont fixées par le CGI (article 1741) à :

5 ans d'emprisonnement
500 000 euros d'amende.

The sighting comes just days after 2 Great White Sharks were seen frolicking in the same area. While not impossible, it does seem unlikely. However, two Great White Sharks have managed to survive the trip and make their way up the Mississippi River somehow. Believed to have started as a mating couple, the two are assumed to have swam the 920 mile journey from the mouth of the Mississippi River that is connected to the Gulf Of Mexico. Officials in Saint Louis have contacted the Missouri Conservation Department and will likely have a team in the river soon to capture the two lost sharks.
